Privacy Collection Notice – Complainant

This notice describes how we, Sport Integrity Australia, collect and manage personal information when you submit a Complaint using the ‘Make an Integrity Complaint or Report – Formal Complaint’ form on our website, or when you contact us another way to submit a Complaint (such as over the phone or by email).

Collection

We collect your personal information from you when you submit a Complaint using the ‘Make an Integrity Complaint or Report – Formal Complaint’ form on our website, or when you contact us another way to submit a Complaint (such as over the phone or by email). When you submit a Complaint, we may also collect information about you (and if applicable your Parent/Guardian) from your sport’s Relevant Organisation (including National Sporting Organisation).

The collection of this information is authorised under the Sport Integrity Australia Act 2020 (SIA Act) and/or your sport’s National Integrity Framework (the Framework) Complaints, Disputes and Discipline Policy (CDDP).

If we don’t collect this information, we are unable to deal with and manage your complaint under your sport’s National Integrity Framework Policy and will be unable to communicate with you about your matter. 

If we need to collect personal information relevant to your Complaint from a third party, other than what is outlined in this privacy collection notice, we will first attempt to obtain your consent. However, if you are unreachable without prior notice to us for an extended period, or if you are unresponsive to our requests for consent (for example, we are unable to reach you for more than two weeks), we may not be able to obtain information from a third party to progress your Complaint.

Our inability to collect information relevant to your Complaint may impact on how your Complaint is managed and any finding in relation to your Complaint.

Use and disclosure

We ordinarily use and disclose your personal information and information contained in your Complaint to deal with and manage your Complaint under the Framework CDDP. This includes:

  • if your Complaint is evaluated as in-scope, we will disclose a copy of your Complaint, or information about your Complaint (such as a summary), to the Respondent/s identified in your Complaint so that they can respond
  • if your Complaint is evaluated as in-scope, we will disclose a copy of your Complaint or information about your Complaint to your sport (such as state, national or international body) for the purpose of investigating your Complaint or communicating Sport Integrity Australia’s findings in relation to the Complaint
  • we may also contact other parties in relation to your Complaint, such as witnesses, and disclose a copy of your Complaint, or information about your Complaint, to witnesses, for the purpose of gathering information in relation to your Complaint
  • we may also use your personal information (including information provided in the Complaint) to communicate with you, or other identified parties to your Complaint, throughout any investigation that Sport Integrity Australia may undertake in relation to the Complaint 
  • if your Complaint includes information about potential imminent harm, an ongoing risk of harm or information about criminality, we may provide your details or information relating to your Complaint to a relevant law enforcement body, sporting organisation, or other relevant parties
  • information you provide in your Complaint may be de-identified and used to understand trends and patterns of issues that may be present in a sporting organisation. We may use this information to better understand the nature of integrity issues in Australian sport, and to support the development of programs to prevent and better respond to integrity threats in sport.

In addition to the above, we may disclose your personal information and information contained in your Complaint to:

  • a National Sporting Organisation
  • law enforcement
  • a tribunal, committee, or other investigative body.

In certain circumstances, we may disclose your personal information overseas to:

  • international law enforcement
  • international sporting organisations
  • the International Olympic Committee
  • a tribunal, committee, or other investigative body.

In some circumstances we are permitted to disclose your personal information without your consent, as set out under Part 8 of the Sport Integrity Australia Act. This may include disclosure to certain bodies and persons described in section 68B(3) of the Sport Integrity Australia Act and disclosure to reduce a threat to life or health, as set out in section 68C of the Sport Integrity Australia Act.
